Today, I’m at Bundaberg Magistrates Court, client was charged with repeat drink driving. Today was a reading of .088. The previous offences were readings of .148 and 0.050. Yes, it was a repeat offence. Fortunately, the other two were outside of the last five years, which meant the worst case today was a nine month disqualification. Mandatory Minimum was technically one month, but obviously with that reading and that history, it’s not easy to persuade a magistrate to go that low. Because he’d been charged with unlicensed driving about three years ago and disqualified for a month, that made him ineligible to apply for a work licence. To be eligible to apply, you can’t have lost your licence for any reason in the last five years. We got our client to complete a reformatory course that could be done online, got him to get references based on a template we provide all of our clients.

I flew up this morning, met the client at court. We grabbed a conference room, I ran through my submissions, the procedure, what he can expect in the courtroom. I did have to push the matter reasonably forcefully, because I was trying to get the disqualification down as low as possible. But I was ultimately successful in persuading the magistrate to give the minimum one month disqualification and a modest fine. So, one month disqualification, obviously he can’t drive for a month, but in a month he goes from losing his licence and he’s back on the road and back to working.
