All right, so I’m at Biloela Magistrates Court. It’s about a one hour flight north west of Brisbane. Client was charged with low range drink driving, reading a 0.081. He’s from New South Wales, so obviously for that reason he doesn’t hold a Queensland driver’s licence and because he doesn’t hold a Queensland driver’s licence, he couldn’t apply for a DUI drink driving work licence. Just to sort of rehash earlier videos I’ve done on this issue, to get a DUI drink driving work licence, one of the prerequisites is that you hold a current Queensland driver’s licence on the day you’re intercepted. Because that wasn’t the case, he was not able to apply for a DUI drink driving work licence, so my job is one of getting the disqualification down as low as possible.

Low range 0.081, worst case is a nine month loss of licence, mandatory minimum is one month. With regard of preparation, I asked him to do an online course about road fatalities and that kind of trauma. I got him to get a bunch of character references based on a template we provide all of our clients. I came up yesterday, flew up, met the client this morning. We grabbed a conference room, ran through my submissions, what he can expect the magistrate to say, prosecutor, myself, et cetera.

The prosecutor was seeking a three month disqualification. I was obviously here to get it down as low as possible. Look, the short version is I was able to persuade the magistrate to give the mandatory minimum one month, so my client got a one month disqualification. Modest fine. He’s obviously very happy. He’s off the road for a month, then in a month, he goes and renews his licence and he’s back on the road.
